Style Squad 2018

Terms and Conditions: 

General:

  1. This competition will run from 30 March 2018 – 12 October 2018 and will consist of 5 rounds.
  2. There will be 2 winners – 1 girl and 1 boy.
  3. By entering this competition, you agree to be bound by these terms and conditions.
  4. Competition entry fee is free, subject to the provisions of clause 10 below, and only for children aged between 9 & 15 within the Republic of South Africa.
  5. Competition entry is free and participants may only enter once during the qualifying competition period. Once final submission is made, entrants may make changes to their contact details or basic information only. To ensure that the changes are requested by the entrant him/herself, entrants will be required to correctly answer questions relating to their entry before any such changes will be made.
  6. Entrants can make changes specified in (5) by contacting our call centre on 0860 900 100 or info@ackermans.co.za. Queries will be answered on Monday to Friday between 8am and 5pm and can take up to 48 hours to be attended to.
  7. For every entry, a unique and valid email address is required from the parent/ guardian.
  8. You are not eligible to enter this competition if you are:
    • A  director, member, partner, employee, agent or consultant of the Pepkor Group of companies, its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the competition
    • A spouse, life partner, parent, child or sibling, immediate family member, business partner or associate of the person/s specified in 8(a)
  9. By confirming entry into the competition, the entrant’s parent/ guardian gives consent for the entrant to complete all rounds of the competition that he/she is eligible for.
  10. Entry into the competition, as well as the completion and submission of all activities, is done online, at the expense of the entrant and using his/ her own digital device.
  11. All prizes in this competition cannot be exchanged for cash.
  12. Ackermans and their delivery agent does not accept responsibility or liability for any loss or damage and will also not be responsible or liable for any further expenses or fees required for purpose of using, applying or enjoying the prize won in this competition.
  13. Participants give Ackermans and its authorized agents consent to use their names and images for publicity purposes across any channel.
  14. Ackermans reserves the right to vary, suspend, postpone or terminate the competition and any prizes, or any aspect thereof, for any reasons whatsoever and without notice. In such event, you hereby waive any rights or expectations which you may have against Ackermans and acknowledge that you will not have any recourse or claim of any nature against Ackermans.
  15. By participating in this competition, you consent to (i) the processing of your personal information by Ackermans and other companies in the Steinhoff Africa Retail Limited (STAR) group, any of their operators, agents and sub-contractors (who may be outside South Africa) on the condition that they will keep such information confidential;  (ii) the collection of your personal information from any other source to supplement the personal information which Ackermans has about you;  (iii) the retention by Ackermans of your personal information for as long as permitted for legal, regulatory, fraud prevention and marketing purposes; (iv) Ackermans using your personal information to send you information about products, services, and special offers of the various companies in the STAR group that may be of interest or value to you.
  16. You can choose to be excluded from direct marketing by declining the marketing consent option on the competition entry form, notifying Ackermans in writing, or by registering a block on any registry which Ackermans is bound by law to recognize. Ackermans will not charge you a fee to update this request on its systems. Ackermans will give effect to any changes requested by you as soon as reasonably possible.
  17. Ackermans operate various social media communities on various social media services and are glad to have you as a community member. We encourage you to interact with us and other community members through our communities. To this end, you are kindly referred to our external media policy and we encourage you to familiarize yourself therewith prior to agreeing to be bound thereto.

Round 1:

  1. Round 1 of the competition will run from 30 March 2018 up until and including midnight on 30 April 2018.
  2. You may enter the competition via the following channel: https://stylesquad.ackermans.co.za/enter
  3. To enter the competition, the online entry form must be completed, with all mandatory fields completed, and you must upload a picture of yourself. The photo may not be larger than 5MB – only JPEGs and GIFs accepted. Participants must be able to read and write English (at their grade level) to enter. 
  4. Parents/ guardians are permitted to enter more than one child but will require a unique and valid email address for each child entered.
  5. You may not be younger than 9 years nor older than 15 years by the starting date of the first round of the competition (30 March 2018).
  6. The photo of the entrant’s outfit and the written description thereof cannot be changed after submission.
  7. Where multiple entries are received, only the first entry will be accepted.
  8. Upon successful completion of the entry form, all entrants will receive a SMS confirming their entry into the competition and notifying them of when the first activity will be sent via email. It is the entrant’s responsibility to ensure that the first activity deadline is not missed in order to progress in the competition.

Round 2:

  1. The second round of the competition will run from 1 – 30 May 2018.
  2. All successful entrants from round 1 will receive the first of 4 fashion activities via email on 1 May 2018. They are required to complete it online, according to the instructions given, by 22 May 2018 in order to continue in the competition.
  3. Once final submission of the first activity is confirmed, the entrants’ photos and supporting written content cannot be changed. Should a successful entrant not submit or correctly complete his/ her activity before midnight on 22 May, he/ she will automatically be disqualified from the competition without notice and no longer be eligible to continue.
  4. The entrants’ activities (including photos and written content) will be uploaded to the Ackermans Style Squad website and/or social media platforms for others to view and share the content.
  5. The public will be able to vote for their favourite entrants from those who have successfully completed the first activity within the given time. Entrants with the most votes will proceed to the next round.
  6. Voting will be open from 24 – 30 May 2018. Voting is free of charge and limited to 1 vote per person, per entrant. Round 3:

  1. The third round of the competition will run from 1 June – 2 July 2018.
  2. Entrants who advance from the second round will be notified of their progression in the competition via email on 1 June 2018 and via SMS on 2 June 2018.
  3. These entrants will receive the second of 4 fashion activities via email on 1 June 2018. They are required to complete it online, according to the instructions given, by 22 June 2018 in order to continue in the competition.
  4. Once final submission of the second activity is confirmed, the entrants’ photos and supporting written content cannot be changed.
  5. Should a successful entrant not submit or correctly complete his/ her activity before midnight on 22 June, he/ she will automatically be disqualified from the competition without notice and no longer be eligible to continue.
  6. The entrants’ activities (including photos and written content) will be uploaded to the Ackermans Style Squad website and/or social media platforms for others to view and share the content.
  7. The public will be able to vote for their favourite entrants from those who have successfully completed the second activity within the given time. Entrants with the most votes will proceed to the next round.
  8. Voting will be open from 25 June – 2 July 2018. Voting is free of charge and limited to 1 vote per person, per entrant. Round 4:

  1. The fourth round of the competition will run from 4 July – 3 August 2018.
  2. Entrants who advance from the third round will be notified of their progression in the competition via email on 4 July 2018 and via SMS on 5 July 2018.
  3. These entrants will receive the third of 4 fashion activities via email on 4 July 2018. They are required complete it online, according to the instructions given, by 25 July 2018 in order to continue in the competition.
  4. Once final submission of the third activity is confirmed, the entrants’ photos and supporting written content cannot be changed.
  5. Should a successful entrant not submit or correctly complete his/ her activity before midnight on 25 July, he/ she will automatically be disqualified from the competition without notice and no longer be eligible to continue.
  6. The entrants’ activities (including photos and written content) will be uploaded to the Ackermans Style Squad website and/or social media platforms for others to view and share the content.
  7. The public will be able to vote for their favourite entrants from those who have successfully completed the third activity within the given time. Entrants with the most votes will proceed to the next round.
  8. Voting will be open from 27 July – 3 August 2018. Voting is free of charge and limited to 1 vote per person, per entrant. Round 5:

  1. Entrants who progress from the fourth round will become the Style Squad 2018 finalists and will receive the following prizes:
    1. Ackermans fashion voucher
    2. Style Squad memorabilia
    3. Title of a Style Squad finalist 2018
    4. A chance to:
      • Win 2x all-expenses paid trips to the Ackermans Support Centre in Cape Town to design and create their own summer and winter fashion ranges, which will be sold in all Ackermans stores across Southern Africa
      • Win R5000 for their school
      • Win an educational policy to the value of R10 000
      • Win R10 000 in cash
      • Win 2x all-expenses paid trips to Cape Town for professional photo shoots in each of the designed ranges
  2. Prizes cannot be exchanged for cash.
  3. Finalists will be notified of their progression in the competition via email on 6 August 2018 and via SMS on 7 August 2018.
  4. The finalists will receive the fourth and final fashion activity via email on 6 August 2018. They are required to complete it online by 31 August 2018 in order to be eligible for selection as the Style Squad 2018 winners.
  5. Once final submission of the fourth activity is confirmed, the finalists’ photos and supporting written content cannot be changed.
  6. Should a finalist not submit or correctly complete his/ her activity before midnight on 31 August 2018, he/ she will automatically be disqualified from the competition without notice and no longer be eligible to win.
  7. The fourth activity completed by the finalists will be reviewed by a panel of Ackermans judges and awarded points based on the creativity, design excellence, level of effort and instruction correctly followed by each finalist.
  8. The finalists with the highest scores will then be interviewed via phone or video call by the organisers.
  9. Should the organisers not reach the top scoring finalists after 3 attempts, the next highest scoring finalists will be contacted for the interview.
  10. The 2 winners (1 girl & 1 boy) will be selected based on a combination of the highest scores received for the fourth activity completed and the best performing interviews. The winners will be notified no later than 7 September 2018.
  11. Once the winners have been selected, the judges’ decisions are final and no debates will be entered into.
  12. Should the organizers be unable to reach the winners after 3 attempts, alternative winners will be selected.

Grand Prize:

  1. The 2 winners (1 girl and 1 boy) selected from round 5 will each take part in a fashion design program for Ackermans and their ranges of clothing (winter and summer ranges) will be sold in all Ackermans stores across Southern Africa.
  2. The 2 winners will have photoshoots for both summer and winter ranges.  Images and video footage from the photoshoots will be used to promote the fashion ranges across Ackermans’ advertising channels, which may include the Ackermans and third party websites, Ackermans social media platforms, Ackermans emailers/ smses, The Sound of Ackermans radio station, Ackermans magazine, any print titles, TV channels and in all Ackermans stores.
  3. The winners and one guardian/ parent will be required to travel to Cape Town on 4 occasions:
  4. 3-4 days which will be spent at the Ackermans Support Centre in Cape Town in order to design and finalise their winter range with the Ackermans team. Exact dates will be communicated by 28 September 2018.
  5. 1 day shoot in Cape Town for the winter range, exact dates will be communicated by end February 2019.
  6. 3-4 days which will be spent at the Ackermans Support Centre in Cape Town in order to design and finalise their summer range with the Ackermans team. Exact dates will be communicated end March 2019.
  7. 1 day shoot in Cape Town for the summer range, exact dates will be communicated by end July 2019.
  8. Should the winners be based outside of Cape Town, Ackermans will arrange and pay for flights, transport, accommodation (not applicable for 1 day photoshoots) and meals on behalf of the winners and  one guardian/ parent per winner:
    • Flights/ airlines will be selected based on best price and Ackermans will not be liable for any loss or damage to the luggage of the winners and parents/ guardians.
    • The winners will be provided with meals and beverages to a limited value while at the Ackermans Support Centre and selected hotels. Any breakfasts, lunches, dinners, beverages or snacks privately arranged by the winners or their parents/ guardians will be at their own expense.
    • Ackermans will not be responsible for supplying spending money or covering the costs of any leisure activities.
    • Ackermans will not cover any additional costs such as spa expenses, room service or mini bar usage.
    • Any additional transport, other than for the purposes of the fashion range creations /photoshoots will be at the arrangement and expense of the winners’ parents/ guardians.
  9. Last but not least the winners will have the title of Style Squad winners 2018

A. Rewards Club Charity Competition

  1. Ackermans A. Rewards club members can nominate a registered charity to stand a chance to win R5000. One charity will be chosen per month who will receive R5000 cash from Ackermans. Only charities that are registered will qualify for the nomination. The winning charity will be chosen at the end of each month when a magazine is published. That is a total of 8 charities per year that will benefit. 

  2. To enter the charity you have to describe what the charity does and why you support it. You have to include your Ackermans account number, a photo of yourself and contact details for you and the charity. All nominations has to be sent to The Editor, Ackermans letter, PO Box 440, Green Point 8051 or emailed to Leanne@newmediapub.co.za.

  3. Directors, members, partners, employees or agents of or consultants to anyone associated with the organisation of these competitions or a spouse, life partner, business partner, associate or family member of such a person are not eligible. 

  4. The prizes are as described and may not be transferred. The judges’ decisions are final and no correspondence will be entered into. 

  5. Should winners not be contactable telephonically, they will have 3 months from date of competition closure to claim their prize. Failure to do so will result in their entry being declared void. All winners may be asked to produce their ID documents and Ackermans cards when claiming their prizes.

  6. Ackermans and their delivery agent does not accept responsibility or liability for any loss or damage and will also not be responsible or liable for any further expenses or fees required for purpose of using, applying or enjoying the prize won in this competition.

  9. The Ackermans A. Rewards Club is only available if you are an Ackermans Account holder and currently residing in South Africa.

Customer Satisfaction Tracker

  1. The competition will run from the start of one calendar month and end on the last date of the month in question i.e. 01 Jan 00:01 to 31 Jan 23:59 each month.

  2. By entering the competition, you agree to be bound by these terms and conditions. You may enter the competition via SMS, or on the Internet. 
  3. Entry into the competition via the SMS survey channel will be charged at normal SMS rates, entry via the Internet channel, will require data. Customers can do the survey once a day, during the qualifying competition period. 

  4. To enter the competition a participant must SMS ‘MySay’ to 44007. You can do the survey via the Internet by clicking on the link provided or by SMS by replying with the word ‘GO’. The survey must be completed fully; no unfinished surveys will be taken into consideration. A completed survey will create an automatic entry into the competition.

  5. The competition is open to all participants within the Republic of South Africa. You are not eligible to participate in this competition if: -

    a. You are a director, member, partner, employee, agent or consultant of the STAR Group of companies, its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the competition;

    b. You are a spouse, life partner, parent, child or sibling, immediate family member, business partner or associate of the persons specified in 5(a) above;.

  6. Monthly draws for a winner will happen between the 5th and 10th of the following calendar month, following the month in which the survey ran, i.e. for a survey run between 01 Jan 00:01 to 31 Jan 23:59, the draw will take place between the 5th to 10th of February.

  7. Winners will be selected by means of a random draw, based on the previous calendar month survey entries.

  8. Winner will win their share of R 2000.00 worth of airtime

  9. In the event that the winner is on a contract option with their network provider company, a R 2000.00 Ackermans virtual voucher will be sent to the number the customer used to enter the survey.

  10. Winners will be contacted between 10am and 3pm on the day of the draw to arrange the prize. Calls may be recorded for verification purposes

  11. An alternative winner will be drawn if after 3 attempted calls the organisers cannot reach the initial winner.

Website survey competition 

Terms and Conditions:

  1. The competition period will commence on 1 April 2018 and will run for the duration of the calendar year.

  2. By entering the competition, you agree to be bound by these terms and conditions. You may enter the competition via the Internet which will require the use of an internet connection or data charges.

  3. You can do the survey via the Internet by clicking on the link provided at the bottom of the webpage or on the website pop-up. The survey must be completed fully; no unfinished surveys will be taken into consideration. A completed survey will create an automatic entry into the competition.

  4. The competition is open to all participants within the Republic of South Africa. You are not eligible to participate in this competition if: -

      a.  You are a director, member, partner, employee, agent or consultant of the Pepkor Group of companies, its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the competition;

Celebrate Mom Competition 2018

  1. This competition will run from 10 May 2018 – 31 August 2018 and consists of 3 phases.

  2. The competition organisers will randomly select 27 winners representing all provinces across South Africa, based on entries received.
  3. By entering this competition, you agree to be bound by these terms and conditions. 

  4. Competition entry fee is free, and only for participants within the Republic of South Africa that are South African citizens (in possession of a valid South African ID book or card) and South African residents (in possession of a valid South African permanent residency permit).

  5. Each entry will require the participant to complete an online entry form:

      a) Submitting their own basic information and contact details;
      b) Information for mom they are entering and the special message for that mom. 

  6. Once final submission is made, participants may make changes to their own or their mom’s basic information or contact details only. To ensure that the changes are requested by the participant him/herself, participants will be required to correctly answer questions relating to their entry before any such changes will be made.

Phase 1: 

  1.  Phase 1 of the competition will run from 10 May 2018 up until and including midnight on 13 May 2018. 
  2.  You may enter the competition via the following channel: https://mom.ackermans.co.za
  3. Entries open 10 May 2018 and close at midnight on 12 May 2018.

  4. To enter the competition, the online entry form must be completed, with all mandatory fields completed, and you must type in a message to your selected mom, within the allocated character limit. 

  5. Participants are permitted to enter more than one mom but will require a unique and valid South African cell phone number for each mom entered.

  6. Participants may enter any mom who is special to them, including but not limited to, their biological mother, foster mother, grandmother, sister, aunt, cousin, daughter, colleague or friend. 

  7. The message submitted by the participant to the mom cannot be changed after submission.

  8. Participants are not permitted to enter the same mom more than once. Where multiple entries are received from the same participant for the same mom, only the first entry will be accepted. Upon successful completion of the entry form, all messages to selected moms will display on the gallery of the Ackermans website https://mom.ackermans.co.za/messages-for-moms. All moms entered will receive the messages dedicated to them by participants via SMS on Mother’s Day, 13 May, free of charge for participants. 

  9. Any messages that are of a hurtful nature or containing inappropriate language or comments not in keeping with Ackermans’ values, will be removed from the website immediately and without notice to the participant. Removed messages will not be sent via SMS to the intended recipient.

  10. All moms successfully entered into the competition by participants will automatically be entered into a lucky draw and stand the chance to receive 1 of 27 makeovers, to take place at her nearest Ackermans store within South Africa.

Phase 2: 

  1.  The second phase of the competition will run from 14 May – 8 August 2018. 
  2.  A total of 27 moms will be randomly selected by Ackermans representatives from all the moms entered into the competition by participants, and will win a full makeover. 
  3. The winners will be contacted by an Ackermans representative on 24 and 25 May. When contacted, the winning moms are required to accept the competition terms and conditions in order to receive the prize of a full makeover. By accepting the competition prize, the winners entered by participants give Ackermans and its authorized agents consent to use their names and images for publicity purposes across any channel.

  4. Should the organizers be unable to reach the winners after 3 attempts, or should any of the winners not accept the competition prize, alternative moms entered by participants will be selected. Makeovers will be done by the Ackermans Magazine Fashion Editor and her assistant, at the Ackermans stores nearest to each of the winners. The makeovers will include clothing – to the value to of R1 000 each, hair and make-up and will take place any time from 28 May – 11 June 2018. 

  5. Photographs and video footage of the wining moms will be taken prior to, during and after the makeovers and will be captured by a professional photographer and videographer.

  6. Photographs and video footage will be used to promote the competition across Ackermans’ advertising channels, which may include the Ackermans and third party websites, Ackermans social media platforms, Ackermans emailers/ SMSes, USSD, Ackermans app, The Sound of Ackermans radio station, Ackermans magazine, any print titles, TV channels and in all Ackermans stores.

Phase 3: 

  1. The third phase of the competition will run from 9 – 24 August 2018.
  2.  The images of all 27 moms – both those taken prior to and after the makeovers – will be shared on Ackermans’ advertising channels from 7 August 2018 and the public will be prompted to vote for their favourite makeover.
  3. Channels on which the images specified in (33) may be shared include the Ackermans and third party websites, Ackermans social media platforms, Ackermans emailers, Ackermans app, Ackermans magazine, any print titles, TV channels and in all Ackermans stores. Communication to the public to vote may also be done via SMS, USSD and The Sound of Ackermans radio station.

  4. The public will be able to vote for their favourite makeover from the 27 moms. Voting will be open from 9 – 24 August 2018 and can be done via USSD only. Voting is free of charge and limited to 1 vote per person, per entrant. To vote, dial *130*602# from your cell phone and follow the prompts to enter the desired entrants’ unique number, which can be found on the gallery page of the website https://mom.ackermans.co.za/messages-for-moms

Grand prize: 

  1. The mom who receives the most votes will be named the Celebrate Mom 2018 competition winner and will receive the following prizes:

      a) A professional photoshoot in Cape Town, including clothing, hair and make-up
      b) Exposure across Ackermans’ advertising channels, which may include the Ackermans and third party websites, Ackermans social media platforms, Ackermans emailers/ Smses, USSD, Ackermans             app, The Sound of Ackermans radio station and any print titles
      c) Be featured on the cover of the Ackermans magazine

  2.  The winner will be required to travel to Cape Town for 1 day for the photoshoot. Should the winner be based outside of Cape Town, Ackermans will arrange and pay for flights, transport and meals on behalf of the winner only:

      a) Flights/ airlines will be selected based on best price and Ackermans will not be liable for any loss or damage to the luggage of the winner.
      b) Any additional transport, other than for the purposes of the photoshoot will be at the arrangement and expense of the winner.
      c) Ackermans will not cover any additional costs such as accommodation, room service or mini bar usage.
      d) Ackermans will not be responsible for supplying spending money or covering the costs of any leisure activities.

Cell C Ackerman’s Campaign

1. General

1.1 It is important that you understand and agree to these terms and conditions in order for you to participate in the Cell C Ackerman’s Campaign (the “Campaign”).
1.2 All standard terms and conditions of Cell C Limited and Cell C Service Provider Company (Pty) Limited apply to this Campaign.
1.3 This Campaign is organised by Cell C Limited, registration number 1999/007722/06 ("Cell C").
1.4 This Campaign is open to all Cell C customers who are over the age of 18 years and who purchase a selected Cell C handset from any participating Store, and successfully Rica and Recharge.

VODACOM 3G and 4G device retail Smartphone Promotion  

Terms and Conditions: 

  1. The Vodacom 3G and 4G smartphone retail campaign (the “Promotion”) will run from 01 April 2018 until 30 September 2018 (both days inclusive) (the “Promotion Period”).

  2. New and existing Vodacom prepaid customers (excluding Community Service and SIGI customers) can participate in the promotion.

      a. Post-paid, Hybrid/Top-Up, both new and existing, as well as existing prepaid customers are excluded from this promotion.

  3. A qualifying customer purchasing a new, qualifying 3G smartphone from a  Vodacom Franchise or National Chain store on prepaid will get 100MB every month for 6 months provided that they meet a total monthly recharge value of R12,00.

      i. Customers has to recharge with R12,00 every 30 days to receive their data allocation.

        (the “Recharge Criteria”)

  4. A qualifying customer purchasing a new, qualifying 4G smartphone from a  Vodacom Franchise or National Chain store on prepaid will get 200MB every month for 6 months provided that they meet a monthly recharge criteria of R29,00

      i. Customers has to recharge with the R29,00 every 30 days to receive their data allocation.

  5. A qualifying smartphone is defined as a mobile phone that performs many of the functions of a computer, typically having a touchscreen interface, Internet access, and an operating system capable of running downloaded applications. In addition a Smartphone is as per GSM classification/ definition.   
  6. 100MB (100 megabytes) for 3G enabled smartphones and 200MB (200 megabytes) for 4G enabled smartphones will only be activated if the new Vodacom Prepaid SIM card is inserted into the qualifying smartphone purchased at participating Vodacom Franchise or participating retailers. 
  7. The data allocations have a 7 day validity period monthly. 

  8. Data rewards are available for use within a specified validity period of 7 (seven) days from date of activation. 
  9. Allocation may take up to 72 (seventy two) hours from activation.
  10. Data may not be transferred 
  11. Data allocated does not apply to data roaming.
  12. Data allocated will not carry with it a separate out-of-bundle rate and the standard out-of-bundle rate specific to the customer’s prepaid price plan will apply for any out-of-bundle usage of R2,00 per minute.  
  13. The Promotion is only valid in selected Vodacom Franchise stores and National Chains during the Promotion Period.
  14. The duration of the Promotion may be extended or curtailed at the discretion of Vodacom.  
  15. In the event of a dispute in regard to any aspect of the Promotion and/or the Terms and Conditions, Vodacom’s decision will be final and binding and no correspondence will be entered into.
  16. Neither Vodacom or any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors and any of its personnel involved in the competition, shall be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from participation in the Promotion.  

  17. If Vodacom is required by law to alter or cancel any aspect of the Promotion or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Promotion being offered, with immediate effect and without notice. In such event all participants hereby waive any rights which they may have against the Vodacom and its associated companies, agents, contractors and/or sponsors.

  18. All information relating to the Promotion which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.
