Ackermans Baby of the Year Competition 2013

The following terms & conditions apply to the Ackermans Baby of the year 2013 Competition:

  1. The name of the competition is Ackermans Baby of the Year 2013.
  1. The competition will run from 1 March 2013 to and including 30 June 2013.
  1. By entering the competition, you agree to be bound by these terms and conditions. You may enter the competition via your cellphone at or online at www.ackermans.co.za
  1. Participants may enter once during the qualifying competition period.
  1. To enter the competition a Participant has to complete the online entry form and upload a picture of their baby. The photo may not be larger than 2MB –only JPGs or GIFs formats accepted. Participants must be either the parent or guardian of the baby. Ackermans reserves the right to request proof of such relation. If it is proven that there is no relation between the baby and the person who sent the photo, that person will indemnify Ackermans against any claim from any third party.
  1. The baby may not be older than 24 months by the closing date of the competition i.e. 30 June 2013.
  1. The competition is open to all participants within the Republic of South Africa, Botswana, Namibia, Lesotho and Swaziland. You are not eligible to participate in this competition if: -
    1. You are a director, member, partner, employee, agent or consultant of Ackermans
    2. You are an immediate family member, of the persons specified in 7(a).
  1. A panel of judges will decide on 12 finalists on the basis of which entries were the most adorable/cute. The finalists will be decided in groups of 4 and published in the magazines Baba n Kleuter, Mamas and Papas, Bona, Living and Loving, Club Magazine, Move, Your Baby.  The finalists will be contacted via telephone within a week of the decisions taking place for verification of details and information on which publication will feature the finalist during the months May to August.
  1. An alternative winner will be decided if after 3 attempted calls the organisers cannot reach the initial finalist.
  1. The 12 finalists will be featured together in the August issue of Move magazine, the September issue of Baba n Kleuter, Mamas and Papas, Bona, Living and Loving and the Sept/Oct issue of Your Baby and Ackermans Club Magazine.
  1. From the 12 finalists, the panel of judges will decide, based on which entry was the most cute/adorable, on the ultimate winner during September 2013 and the winner will be featured in the October issue of Move, Huisgenoot, You, Drum, the November issue of Baba n Kleuter, Mamas and Papas, Bona, Living and Loving, and the Nov/Dec issue of Your Baby and Ackermans Club Magazine. The Winner will be contacted within one week of the final decision being made via telephone.
  1. The 11 finalists will each win a R1000 Ackermans gift card, an ABC hamper to the value of R250 and be featured in the Ackermans Baby Calendar. Only after the ultimate winner has been determined will finalists’ prizes be delivered.
  1. The grand prize the winner will receive is a R10 000 Old Mutual education policy (R20 000 if the parent/guardian is an Ackermans accountholder when entering), a R5 000 Ackermans gift card, a feature in the Ackermans Club magazine and ABC Baby Calendar, a subscription to either HYD or Move magazine and a subscription to either Baba &Kleuter or Your Baby magazine, a Samsung Galaxy Tablet, an ABC hamper to the value of R1 000.
  1. An alternative winner will be decided if after 3 attempted calls the organisers cannot reach the initial winner.
  1. The winner will be expected to fulfill the following duties from time to time:
  • Be available for photo shoots and be willing to feature in any advertising for Ackermans
  • Be prepared to travel to Cape Town or Johannesburg for the shoot.  Ackermans will arrange travel and  accommodation
  • Furthermore, the parent or guardian agrees to their baby’s image being used by Ackermans.  This may be, but not limited to, print, television, in-store and on-line material.
  1. The finalists have 7 days from being contacted to submit their identification to claim their prizes. Prizes not claimed within this period will be forfeited. Prizes cannot be exchanged for cash.
  1. Ackermans and their delivery agent does not accept responsibility or liability for any loss or damage and will also not be responsible or liable for any further expenses or fees required for purpose of using, applying or enjoying the prize won in this competition.
     
  2. Ackermans reserves the right to vary, suspend, postpone or terminate the competition and any prizes, or any aspect thereof, for any reasons whatsoever and without notice. In such event, you hereby waive any rights or expectations which you may have against Ackermans and acknowledge that you will not have any recourse or claim of any nature against Ackermans

By participating in this competition, you consent to (i) the processing of your personal information by Ackermans and other companies in the Pepkor group, any of their operators, agents and sub-contractors (who may be outside South Africa) on the condition that they will keep such information confidential;  (ii) the collection of your personal information from any other source to supplement the personal information which Ackermans has about you;  (iii) the retention by Ackermansof your personal information for as long as permitted for legal, regulatory, fraud prevention and marketing purposes; (iv) Ackermans using your personal information to send you information about products, services, and special offers of the various companies in the Pepkor group that may be of interest or value to you.

  1. By signing up for the Ackermans card that you have received in your mail pack you are entering the competition, and you agree to be bound by these terms and conditions.
  1. To enter the competition participants need to fill out the Ackermans card account form that was posted to you, fax it to (021) 928 1049 and then activate your account in-store at any Ackermans branch before the closing date of 15h00 on 3 June 2013. Should you choose to also sign up for the Ackermans club, your chances are automatically doubled to win.
  1. The competition is open to all participants within the Republic of South Africa. You are not eligible to participate in this competition if: -
    1. You are a director, member, partner, employee, agent or consultant of the Pepkor Group of companies, its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the competition;
    2. You are a spouse, life partner, parent, child or sibling, immediate family member, business partner or associate of the persons specified in 5 (a) above;
  1. R100 winners will receive R1000 each credited to their Ackermans account to be used towards Fashion or any other merchandise of their choice.
  1. Winners will be selected randomly via a computer operated draw which will be overseen by an auditor. The first draw will take place on 11 March 2013. Each draw will announce7 winners of a R1000 credited to their account and the last  draw 10 June 2013 will announce 16 winners of a R1000 credited to the account.  Each winner will receive R1 000 credited to their Ackermans account. There will be 100 winners in total. Prizes cannot be exchanged for cash.

  1. The competition will run from 1 September 2012 to and including 30 June 2013.
  1. By entering the competition you agree to be bound by these terms and conditions. 
  1. To enter the competition a Participant has to spend R100 or more on her/his Ackermans card buying any of the following merchandise: Dora the Explorer, Hello Kitty, Cars or Spiderman. 
  1. The competition is open to all participants within the Republic of South Africa. You are not eligible to participate in this competition if:
  1. You are a director, member, partner, employee, agent or consultant of the Pepkor Group of companies, its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the competition;
  2. You are a spouse, life partner, parent, child or sibling, immediate family member, business partner or associate of the persons specified in 4(a) above;
  1. All qualifying participants will be entered into the draw which will take place every second month starting on 1 November 2012. Winners will be selected randomly via a computer operated draw. MTN Standard Terms and Conditions of purchase and/or use of Ackermans starter SIM pack.

  1. Benefits.
  1. The SIM card contained in this kit allows the following upon activation:
    1. Standard service benefits:
      1. MTN Call Per Second is the default price plan;
      2. 10 (ten) Free MTN CallBacks daily;
      3. 1 (one) Free SMS daily, when the customer has made a 60 (sixty) second chargeable call on the same day; and
      4. The customer will receive 5 (five) free SMSs for every 15 (fifteen) SMSs sent at standard rates, per day.
    2. Activation Service Benefits (applicable for 3 [three] months from date of activation of the SIM card);
1.1.2.1 Customer will receive R60,00 (sixty Rand) worth of airtime per month for 3 (three) months (MTN to MTN calls only)
  1. The Promotional period shall commence on the 20 May 2013 until 20 August 2013 (the “promotional Period”)
  2. All calls made, excluding those depleted from the free airtime value, shall be billed in units calculated on the MTN PayAsYouGo price plan chosen and activated by you.
  3. MTN Call Per Second Default Price Plan
    1. Calls will be charged at per second rates (units of 1 [one] second) while you are on this MTN PayAsYouGo option.
    2. SMSs will be charged at per unit rates while you are on this MTN PayAsYouGo option.
    3. Each SMS unit is calculated in units of 160 (one hundred and sixty) characters or part thereof.

  1. The MTN PayAsYouGo price plan sets out the price of calls payable for access to the MTN network. MTN reserves the right to alter such prices and fees at any time and without any notice. The price plan can be found on www.mtn.co.za.
  2. RICA
    1. In terms of the Amended Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2002 (“RICA”), you are obliged to provide proof of your full names, surname, ID number and residential address to a RICA officer when purchasing a SIM card from 1 July 2009. This is necessary to activate you as a customer on the MTN network.
    2. MTN is obliged by law not to activate your SIM card on the MTN network if you have not complied with the RICA registration requirements.
    3. By law, if a SIM card is lost, stolen or damaged, you are required to immediately notify the South African Police Services in writing. You will also have to immediately notify MTN and request the SIM card to be suspended.
    4. If you wish to transfer/sell your SIM card to another person (other than a family member), you are required to contact 173 to report such a transfer to MTN, and then MTN is required by law to deactivate the SIM card. Before the new holder of the SIM card can use the SIM card, they must provide proof of their full names, surname, ID number and residential address to an approved MTN RICA officer to register them as a customer on the MTN network. Once they have complied with RICA, and the RICA information is received by MTN, MTN will reactivate the SIM card.
    5. Failure by any person holding/using a SIM card to comply with RICA is an offence. Contact MTN on 173 or see www.mtn.co.za for details.
  3. Connection of SIM card
MTN reserves the right to change the period within which you are required to connect your SIM card to the MTN network from time to time, at MTN’s sole discretion. MTN Access4Life rules and MTN Number4Life rules apply to all MTN PayAsYouGo services. See www.mtn.co.za.
  1. Use of the SIM card
    1. When you use this SIM card, you agree that you:
      1. will not use nor allow the MTN network services to be used for any improper or unlawful purpose, nor in any way that may cause injury or damage to persons or property or an impairment or interruption to MTN’s network services.
      2. will only use mobile devices approved by ICASA, the Regulatory Authority, together with the SIM card on the MTN network, and will comply with all relevant legislation and regulations, as well as all lawful directives given by MTN relating to the use of mobile devices, MTN network services and/or SIM cards.
      3. will accept that no right, title or interest in the software in the SIM card or the cellphone number issued to you, vests in you; however, MTN does acknowledge that Mobile Number Portability allows you to retain the use of your cellphone number if you decide to port.
      4. will not yourself, and will not allow any other person to reverse engineer, decompile, modify or tamper with the software contained in, or relating to, any SIM card or mobile device.
  2. Migration from MTN PayAsYouGo to contract
    1. All MTN Number4Life rules apply. See www.mtn.co.za for further Terms and Conditions and information.
    2. When you move from MTN PayAsYouGo to a contract (that is, a contract package), you will forfeit any and all airtime and benefits not used before you move, but you can keep your MTN PayAsYouGo cellphone number if you comply with the MTN Number4Life rules.
  3. Migration from Ackermans starter SIM to another MTN PayAsYouGo price plan
    1. When you move from Ackermans starter SIM to another MTN PayAsYouGo price plan, you will keep all airtime including all free airtime.
7.2 When you move from Ackermans starter SIM to another MTN PayAsYouGo price plan on this starter pack, you will keep all the starter pack benefits for a period of 3 (three) months only, from the date of activation.
7.3     When you move from Ackermans starter SIM to another MTN PayAsYouGo price plan, you will keep your    MTN PayAsYouGo cellphone number.
7.4      Existing PayAsYouGo customers will not be able to migrate into the Ackermans price plan.
8 Mobile Number Portability (“MNP”)
This gives you the ability to move to another mobile network and still retain your cellphone number. A Caller Line Identity (“CLI”) validation will need to be done to ensure that the number being ported is in the customer’s possession. You will lose any unused airtime, Internet bundle credits, and your voicemail messages when you port. MNP regulations and Terms and Conditions apply. See www.mtn.co.za for further information.

  1. Value Added Services
All value added services depend on the discretion of MTN Service Provider (Proprietary) Limited (“MTN SP”) and MTN SP may withdraw them at any time with notice to you. Visit www.mtn.co.za regularly for notices, updates and/or changes to services.
 

  1. Modification of Terms and Conditions
    1. MTN reserves the right, at any time, to change these Terms and Conditions and any rules relating to its products and services, and to modify its products and services at its discretion.
    2. MTN reserves the right at any time to modify, suspend or discontinue the services with notice, without liability to you or any third party. MTN will under no circumstance be liable to you for any error, delay, failure or non-availability of the service, and you indemnify MTN against any damage or loss you may sustain as a result of possession and/or use of the SIM card, MTN network services, or any error, delay, failure or non-availability of the service. Visit www.mtn.co.za regularly for notice, updates and/or changes to services.
    3. MTN reserves the right from time to time to vary the charges of these services as may be deemed necessary in its discretion.
    4. See www.mtn.co.za for product and services rules and updated Terms and Conditions from time to time. Any changes to rules and/or Terms and Conditions are effective from the date that they are published on the website or elsewhere in any media.
  2. SIM Swap
The SIM Swap service allows you to keep your old preferred MTN cellphone number, subject to certain conditions. After you have registered your details in compliance with RICA, you will be able to initiate the SIM Swap process by following the steps explained in this booklet on your MTN cellphone. A SIM Swap from the new cellphone number to your old MTN cellphone number will be allowed if you are RICA compliant, if the old MTN cellphone number is active and still available on the MTN network, has not been recycled and is not in use by another customer, according to MTN’s systems. A SIM Swap will only be allowed for one cellphone number at any given time. If the new cellphone number has been active/used to make calls for more than 24 (twenty-four) hours, a SIM Swap cannot be performed. The old cellphone number must be deactivated/cut off from the network before the new cellphone number can be activated. Customers will be able to keep their airtime balance from their old SIM card/cellphone number, their MTN PayAsYouGo option and any credits or subscriptions they had once a SIM Swap is performed.
 

  1. MMS
MMSs can be sent to all local South African networks and email addresses. Message delivery is dependent on the recipient’s handset and network capabilities. An MMS-capable cellphone is required for sending and receiving MMSs. Maximum message size is handset dependent.
 

  1. MTN Access4Life Extender
    1. If you wish to go out of the Republic of South Africa and not use your SIM card for a certain period, then you may extend the MTN Access4Life period by paying R20.00 (twenty Rand) and add an additional 90 (ninety) days to the period/life span of the SIM card. Once the initial 90 (ninety) days have elapsed, the additional 90 (ninety) days will be added, keeping your cellphone number connected to the MTN network.
    2. Call 173 to “activate” the service and load sufficient airtime into your wallet (that means the airtime will be allocated to your particular cellphone number) to cover the period. The service will continuously deduct R20.00 (twenty Rand) from your wallet for every 90 (ninety) days that elapses while the service is active.
    3. You will need to cancel the service upon your return to the Republic of South Africa; if failing to do so, the service will continue to deduct R20.00 (twenty Rand) every 90 (ninety) days until it is cancelled.
    4. In the event that you do not have enough airtime in your wallet to enable the MTN Access4Life Extender, the service will be automatically cancelled.
  2. SIM card warranty.
    1. If, within a period of 6 (six) months from the date on which a SIM card is initially activated, the SIM card fails, due to any malfunction that is attributable, in the opinion of MTN, to an error in the manufacturing or programming of the SIM card, MTN will replace the SIM card, free of charge, to you as soon as reasonably practicable. 
    2. MTN shall be entitled to charge a price determined by it, from time to time, for any SIM card replaced by it after expiry of the warranty period referred to in clause 14.1 above.
  3. General.
    1. Should you receive a call on your cellphone, the person making that call will pay the fee at the rates applicable on the relevant network used by the caller.
    2. MTN is not responsible for any calls and/or services being cut off due to your airtime or Internet bundle credit having expired for any reason. MTN will; however, endeavour to contact you to advise you that your airtime minutes are depleted, prior to it running out.
    3. MTN does not warrant or guarantee that it will notify you at that time or at all, and you agree that MTN is not liable for any loss you or any other person may suffer, allegedly as a result of MTN not contacting you at that time or at all.
    4. MTN is not responsible for a call being interrupted and/or failing for any reason or for any interruption in the network services.
    5. You will be able to make and receive calls only when you are in the Republic of South Africa in an area covered by the MTN network in the Republic of South Africa. You will also be able to make or receive calls while you are outside the Republic of South Africa, subject to MTN’s roaming Terms and Conditions. The tariffs and guide on how to manage calls while roaming (outside of the Republic of South Africa) can be found on www.mtn.co.za.
    6. You will be solely responsible for all products and services contained in this kit, from delivery of the kit to you. Accordingly, MTN takes no responsibility for any loss or damage of any of the contents of this kit, including the SIM card, where applicable, or any MTN airtime associated with the SIM card/cellphone number. In the event of theft or loss of your cellphone, airtime and/or SIM card, such items must be replaced at your own cost, and you are obliged to report such loss or theft to the South African Police Services immediately.
    7. MTN is under no obligation to give you any proof of how your airtime has been used or of any calls made or received on your cellphone. Accordingly, MTN is under no obligation to provide itemised information with respect to any call records for your cellphone or cellphone number.
    8. In the event that the purchased SIM card has exceeded the expiry date printed on the packaging/cover, contact 083 173 using another mobile handset for an alternative cellphone number. Please note that you will be unable to contact 173 or make a call with an expired SIM card.
